In a groundbreaking judgment, Petronella Tendai Militala, 56, has emerged victorious in a contentious probate case, securing a significant share of her estranged late husband Winsley Militala’s estate, valued at over $700,000.

Petronella and Winsley’s marriage spanned three decades, marked by joint wealth and assets accumulated over the years. However, their relationship took a tumultuous turn in 2014 when Winsley left their matrimonial home, followed by divorce proceedings initiated in 2017. The divorce was still pending when Winsley passed away in January 2021.

Despite their long-standing union, Winsley’s will surprisingly excluded Petronella, sparking a fierce legal battle. Petronella contested the will, arguing it grossly underestimated their marital assets. The court’s verdict would ultimately decide her entitlement to a fair share of the estate.

High Court Judge Amy Tsanga delivered a landmark ruling, clarifying key aspects of estate planning and distribution. The court deemed Petronella eligible to claim a share of the estate, citing the unfinished divorce proceedings.

Petronella was awarded the matrimonial home, Stand 721 Bannockburn Road, Mount Pleasant Heights, Harare, as well as a 50% share in Stand 1328 Batanai Close, Houghton Park, Harare. Additionally, she received a lump sum maintenance of $288,000 and two luxury vehicles: a Discovery and a Mercedes Benz.

This ruling sets a significant precedent for estate planning and distribution in complex family situations. It emphasizes the importance of considering all parties’ rights and contributions, particularly in cases involving unfinished divorce proceedings.

Petronella’s victory serves as a testament to the court’s commitment to protecting women’s rights and recognizing their contributions to family wealth.
